02
Who we are
Orbital is made in Brisbane by [business name], ABN [ABN]. “We” and “us” in these terms means that business. “You” means the person using the app.
03
Using Orbital
Orbital is for your own personal use, and for people aged [minimum age] and over. By downloading or using it, you agree to these terms.
The notes you keep are about real people. Keep them to things you’d be comfortable with them knowing you wrote down, and don’t use Orbital to track or watch anyone.
Please don’t copy, resell or reverse engineer the app, or try to get around the paywall.
04
Orbital Pro and the free trial
Orbital is free to start. Orbital Pro keeps your windows going after that, and you can buy it as a yearly or monthly subscription, or once as a lifetime purchase. Purchases go through Google Play (or the App Store, once Orbital is on iPhone), and their terms apply to the payment itself.
Prices. In Australia: A$59.99 a year, A$9.99 a month, or A$149.99 once, GST included. Elsewhere, the store shows your local price. The store always shows the exact price before you pay.
The free month. The yearly plan starts with a free month. If you don’t cancel before it ends, Google Play charges you for the first year. You can only have the free month once.
Renewing. Subscriptions renew automatically at the end of each period until you cancel. If we ever change a price, the store tells you before it applies to you, and you can cancel before then.
05
Cancelling and refunds
Cancel any time in Google Play, under Payments & subscriptions. You keep Pro until the end of the period you’ve paid for, and you won’t be charged again. Deleting the app doesn’t cancel a subscription.
Refunds go through Google Play under its refund policy, because they hold the payment. If something has gone wrong, email us as well and we’ll help sort it out. Your rights in section 10 apply either way.
To get Pro back on a new phone, use Restore purchases in the app with the same Google account.
06
Lifetime
Lifetime means Pro for as long as we run Orbital, with no further payments. It doesn’t mean forever regardless of what happens to the app. If we ever stop running Orbital, we’ll tell you in the app at least [notice period, e.g. 90 days] ahead.
07
Note summaries
Note summaries are optional and written by an AI model. They can get things wrong, so check anything important with the person themselves. Don’t rely on a summary for medical, legal, financial or safety decisions.
You choose when a person’s notes are sent for a summary, and what’s in them. The privacy policy explains exactly where they go.
08
Reminders
Orbital does its best to remind you at a good time, but your phone has the final say. Battery saving, Do Not Disturb, turned-off notifications or the system closing the app can all stop a reminder arriving. Please don’t rely on Orbital for anything urgent, like medication, appointments or someone’s safety.
09
Your data
Everything you put into Orbital is yours, and it stays on your phone. Because we don’t keep a copy, we can’t recover it if your phone is lost, reset, or the app is deleted. Your phone’s own backup is the safety net.
10
Your rights under Australian law
Orbital comes with guarantees that can’t be excluded under the Australian Consumer Law. If we fail one, you’re entitled to a remedy, and for a major failure you can cancel and get a refund. Nothing in these terms takes those rights away.
Beyond those guarantees, and as far as the law allows, we aren’t responsible for losses that come from missed reminders, wrong summaries, or data lost from your phone.
11
Changes
We may change the app, and these terms, as Orbital grows. If a change to these terms matters, we’ll tell you in the app before it takes effect. If you don’t agree, you can stop using Orbital and cancel your subscription.
12
